The position of legal dogmatics as 'science of valid positive law' does not mean that it has nothing to do with legislation. The views opposing 'the possible contribution of legal dogmatics to legislation' can be summarized as four theses, which are all rooted in false understanding about legal dogmatics as such. Legal dogmatics has not only functions of stabilization and integration, but also innovative function. On this basis, the theoretical foundation of the reason why legal dogmatics can contribute to legislation lies in the double elements of law and the pursuit of scientific legislation. On the one hand, legal dogmatics can shape the contents of legislation with three influential ways, i.e., providing direct, indirect and critical support to legislation. On the other hand, legal dogmatics can also impact on the systematic style of legislation. This structural molding is comparatively more stable and durable. Thus, in the normative sense, legislation without legal dogmatics is unimaginable. But this does not suggest abolishing the margin of legislation accordingly, but only means that the power of legislature should be restrained rationally. |
