The Third Generation Environmental Regulation

作為一種新的規制模式，第三代環境規制是在社會複雜性顯著增強、綠色商業興起的時代背景下誕生的，因應了前兩代環境規制的現實困境。第三代環境規制的核心意旨是在法律自我限制的基礎上，系統化培育企業自覺提升環境表現的反思性結構。較諸前兩代環境規制，其背後的理論範式和國家責任均發生了深刻變遷，形成了一種代際意義上的新型規制模式。面對日益緊迫的資源環境約束，第三代環境規制具有遠大前景，但在我國的實施尚須解決若干約束條件。

As a new regulation model, the third generation environmental regulation is bom in the back­ground of the growing social complexity and green business, which is also in response to the practical dilemma of environmental regulation in the first two generations. The core meaning of the third generation environmental regulation systematically cultivates the reflexive structure of enterprises on the basis of legal self-limitation. Comparing with the first two generations of environmental regulation, the paradigm and government responsibili­ties behind the third generation environmental regulation have profoundly changed, thus forming a new kind of regulation mode in the inter-generational sense. Facing increasingly urgent resource and environmental con­straints ,the third generation environment regulation has great prospect, however, some constraints must be solved in its implementation in our country.
