試論國軍懲罰評議程序中違失行為人參與權之保障

Discussion on the protection of Procedure Participation Right in the Punishment review system of the Military

人民參與行政決定程序，是憲法維護人性尊嚴、民主法治國及程序基本權的保障與正當行政程序原則之實踐。陸海空軍懲罰法為了呼應軍中人權保障的法治意識，強化行為人參與懲罰評議程序的機能，乃明定其得到場陳述及申辯，對其他未規定之程序參與權部分，如何透過適用行政程序法之程序規定事項加以補充，並依據國軍懲罰案件之特殊性，做最適切之解釋與實務之運作。本文藉由案例所呈現之實務見解，從行為人參與懲罰評議程序所應具備之基本權利，提出問題之釐清與實務執行面之意見，使之更符合憲法程序基本權保障之意旨。

People participating in the administrative decision procedure is the protection of the human dighity, Democratic and Legitimate State, and the Procedural Constitutional Rights defended by the Constitution and the fulfillment of the principle of legitimate administrative procedure. To respond to the protection of the nomocratic awareness of military human rights, reinforce the function of joining the council,the Armed Forces Punishment Act records that people may speak and defend themselves on site, the methods of the addictional supplement on applying on the programmatic rules of Administrative Procedure Law about other parts of procedural rights unspecified, and make the most suitable explanation and practical operation in accordance with the speciality of punishment cases. Through the practical opinions in the cases,this paper puts forwards suggestions on the clarification of problems and the side of executive from the basic rights required by the procedure people joining in for making it more corresponded with the intent of the Procedural Constitutional Rights.
