In this article, we endeavor to understand whether the norm of nationalself-determination, evolving from principle to right, can be extended toIndigenous Peoples. We shall start with the historical development of rightto self-determination followed by an inventory of relevant regulations ininternational conventions. After exploring some theoretical controversies,we will examine the United Nations Declaration on the Rights of IndigenousPeoples. Further, we will probe the concept of Indigenous “People” and thecontent of Indigenous right to self-determination. Conclusions will be onthe limitation of internal self-determination, and the possibility of freshinterpretations. |
