從法系差異論地方政府之規劃裁量空間

A STUDY ON LOCAL GOVERNMENT'S PLANNING DISCRETION IN THE POINT OF LEGAL SYSTEM

在「國土綜合開發計畫法草案」下，開發許可制度的法制化將成為一種趨勢，然而引自英國的「開發許可制」是一種個案審查（merit case by case）的動態式規劃，涉及行政裁量、開發回饋、協商空間等海洋法系的彈性特質，在一個司法體制屬於大陸法系的台灣，都市計畫的彈性裁量空間將與這樣依法行事的行政規則產生衝突，因此本研究從「法系觀點」切入，探討法系差異下地方政府規劃之裁量空間及未來政府權力運作之發展趨勢，以作為台灣在引入不同法系之規劃制度時的參考。

In order to make our planning system more effective and flexible, the government amend national planning guidance gradually and leads planning permission which belongs to Common legal system into our zoning planning system which belongs to Roman legal system. However, the impact caused by the difference of legal system had been ignored. So the study tries to explore the planning system in the View of Legal System. And analysis that planning discretion to local planning authority should be defined flexible or clear.
