陪他走一段路：愛滋感染者申訴歷程的觀察與反思

Reviewing the appeal system for people living with HIV/AIDS

本文主在從一個陪伴愛滋感染者（感染者）走過不同申訴程序的社會工作員的角度，檢視當感染者被侵權時，可使用的申訴制度及其不足之處。全文計分六個部分：在前言及簡述現今感染者可使用的申訴程序後，第一部分與第二部分整理感染者就業侵權申訴面臨的困境；第三部分處理感染者就醫侵權申訴面臨的困境；第四部份勾勒感染者就學侵權申訴面臨的困境。第五部分檢視影響或限制感染者知道或使用申訴制度的因素；並省思這套制度怎樣影響社工員本身。文末提出五個面向建議，以讓申訴制度能逐漸貼近被侵權的感染者。

The purpose of this paper is to make an in-depth review of the appeal system for people living with HIV/AIDS (PLHIV) in Taiwan based on a perspective of a social worker in the HIV/AIDS field. Following the introductory section regarding current appeal system for PLHIV, the contents of the paper are divided into six sections. Section One and Two describe the difficulty encountered by PLHIV in the appeal system for settling the disputes between them and their employers. Section Three studies the difficulty in the appeal system for settling the disputes between them and their medical service providers. Section four details the difficulty and disputes between PLHIV and educational institutions. Section Five outlines the factors limiting or influencing the usage of the appeal system by PLHIV. Finally, some suggestions are provided for improve the appeal system for PLHIV in Taiwan.
