On January 23, 2009, Taiwan enacted the 'Human Trafficking Prevention Act', and implemented it on June 1 of the same year. To explore the effectiveness of the criminalization of human trafficking cases, from the district court verdicts, summary statistics on the type of human trafficking and conviction rate. The overall conviction rate of human trafficking cases was 42.6%, of which 80% was convicted in sexual exploitation cases, 42.6% was convicted in labor exploitation cases. At the same time from the innocent judgment cases, according to the establishment of elements of human trafficking, analysis the reasons of the judge's innocence judgment. Finally, from the 'Legal' and 'Implementation' to make recommendations, so that the court 'under the principle of legality' to determine the facts, apply the law, without neglecting the 'Human Trafficking Prevention Act' focuses on protection of sexual exploitation, labor exploitation of human trafficking victims rights. |
