論水泥產業之空氣污染防治制度——以美國清潔空氣法及我國實務為中心

A Study of Legal System of Air Pollution Control for Cement Industries- Focus on U.S. Clean Air Act and Taiwan Case

有鑑於水泥業所造成的空氣污染問題，本文選擇以水泥業為個案，進行我國空氣污染防治法制的分析，此一研究課題具有學術以及實務上之重要性。本文之研究方法則以比較法為主，希望透過介紹美國之立法例以及實務操作的經驗，提供我國之空污法制與實務操作的具體建議；據此，本文之架構先介紹美國與我國針對水泥業的空污法制，接著挑選美國St. Marys水泥案以及我國之台泥公司訴願案為實務操作的個案，加以介紹並提出評析，最後，以美國之法制與實務操作經驗，針對我國之法制提出建議。

In view of problems of air pollution caused by cement industry, this article focused to the cement industry as issues and legal system of pollution control. This research includes the jurisprudence of academic and substantive. Research methodology herein places based comparative law by describes of the legislation of the US and experience of practical operation, providing specific recommendations of air pollution of legal system and enforcement of law. Therefore, this article first introduced framework the US and Taiwan for air pollution legal system of cement industry, followed by the selection of the US St. Marys of cement and petition of the company TCC as cases of practical operation, be presented, evaluating and propose ideas.
