Currently, the cultural creative industries is promoting strategy by government and civil society institutions, which will enhance the national aesthetics of people and adding value of brand by the design economic and international marking. Although some of cultural and creative products have originality, but easy to imitate and even plagiarism. Therefore, the copyright of product design is very important for the original creators, only of personality rights and property rights are not infringed, then designers put in creative spirit and wisdom to express the design concept of novelty, progressive, and sharing and development of design economy. This will introduce Cultural Creative Industry Development Act and related industries, follow discuss the art works on the graphics relating Copyright Law that includes object of protection, requirements and legal effect for cultural creative products. In addition to individual property rights and personality rights, this article also emphasis the public interest for people life, in order to the balance of legal system and design industry. Finally evaluate the legal practice by court, analyze the facts by parties and the court's opinion for discovery how to protect the rights by copyright law, therefore, the cultural creative designer is involved solutions counterfeit or plagiarism controversy in product design. |
