中國大陸土地徵收法制中的正當法律程序研究

A Study on the Due Process of Law of the Land Expropriation Legal System of Mainland China

土地徵收制度適用正當法律程序，可以規範行政機關的行為，限制土地徵收權的濫用，增加土地徵收程序的透明度和公平性，避免暗箱操作和肆意妄為等現象的出現，以保證被徵收者的權益。隨著經濟和社會的發展，徵收土地作為經濟發展建設需要的情形屢見不鮮；但是，目前的土地徵收程序尚存在不少缺陷，需要進一步的改革和完善。本文以2010年6月9日發生在臺灣地區大埔農地徵收事件為例，探討大陸地區目前土地徵收程序所存在的缺陷，並期以正當法律程序來建構大陸地區的公平合理的土地徵收程序，以實現各方利益平衡，更好地促進經濟和社會的發展。

Applying legitimate legal system in land acquisition system can regulate governmental authorities’ activities, restrict the abuse of land acquisition right, improve the transparency and fairness of the land acquisition procedures, as well as avoid black-box operation and unrestrained willful activities and etc. to protect the rights and interests of the people whose land being acquired. With the economic and society development of our country, it’s very normal to acquire land to meet the development of economic development; however, there are still many defects in the current land acquisition system of our country which need to be further reformed and improved. Taking the farm land acquisition event which happened on June 9th, 2010 in Dapu, Taiwan District for example, this article will study on the defects in the current land acquisition procedures in our country and hope a fair and reasonable land acquisition procedure will be established though legitimate legal procedures to balance the interests of the parties and further promote the economic and social development.
