論食安法之「義務人」及其行政責任——以外國公司、電子商務事業體及多層次傳銷會員等為例

The Determination of ＂Obligators＂ in Act Governing Food Safety and Sanitation and his Administrative Liability-Taking Foreign Companies, E-commerce, and Multi-level Marketing as Examples

「義務人」之認定，於行政法上至為重要，蓋如不能確認義務人，即無從追究違規事件之責任。然而，由於食品安全衛生管理法對於適用之對象，未必有明確之規範，從而在解釋與適用上，時常滋生疑義。為此本文嘗試釐清相關問題並嘗試提出辦理外國公司、電子商務以及多層次傳銷所設食安事件的處理步驟，以作為實務工作者之參考。

It is important to determine ＂obligors＂ in administrative law; if we can not determine the obligors, we will not be able to look into the liability thereof. However, there may not be explicit statute to determine the objects applied to in Act Governing Food Safety and Sanitation; the empirical problem is usually how to interpret and apply the regulations. This article aims to analyze related issues, and provide suggestions on the process of foreign companies, e-commerce, and multi-level marketing, for practitioners' reference.
