The Integration theory of Rudolf Smend had great impact on Germany’s Basic Law after World War II and on the Federal Constitutional Court of Germany, and Smend is one of the most influential Germany scholars of state law of the twentieth century. In comparison to other important scholars of state law during the Weimar period, such as Hans Kelsen, Carl Schmitt and Hermann Heller who have been introduced to us by many academic articles, Smend has clearly received less attention given that the integration theory is relatively abstract and difficult to comprehend. In this article, the author tries to introduce and analyze the Smend’s integration theory and its impact on Germany’s public law after World War II in an attempt to draw more academic attention to this part of the development of Germany’s public law. |
