The paper suggests that the legal cost-benefit analysis is an operable and effective way for calculating the efficiency of law through a review of evaluation criteria of legal efficiency. Legal cost is divided into law making cost and law enforcement cost by theoretical analysis in the paper, among which law making cost should not be included in the law evaluation model, as the cost belongs to sunk cost, and the law enforcement cost includes de-order cost, friction cost and loses. The range of legal benefit should be defined by the object of the law. The paper also proposes the methods for quantifying the costs and benefits, meanwhile, theoretical framework of evaluation criteria of legal efficiency has been presented. Finally, we apply the theoretical framework to the analysis of the efficiency of forest logging quota management system. |
