法律效率量化框架的理論研究－－兼論森林採伐限額管理制度對此框架的應用

Theoretical Research on the Framework of Law Efficiency Quantifying: Application of Forest Logging Quota Management System to the Framework

通過對各個法律效率評價標準進行評述，提出法律成本收益分析法是測算法律效率的可操作的有效標準。在理論上將法律成本進一步分解為法律制定成本與法律實施成本，其中，法律制定成本屬於沉沒成本，不應納入法律效率的評價模型之中；法律實施 成本包括脫序成本、第二類摩擦成本及失益成本。對於法律收益，提出以法律目標為指引的確定方法。本文同時給出每一類法律成本及收益的具體測度方案，並構建出法律效率量化的理論框架，最終通過森林採伐限額管理制度驗證了該理論框架的可操作性，從而使得法律效率評價成為可能。

The paper suggests that the legal cost-benefit analysis is an operable and effective way for calculating the efficiency of law through a review of evaluation criteria of legal efficiency. Legal cost is divided into law making cost and law enforcement cost by theoretical analysis in the paper, among which law making cost should not be included in the law evaluation model, as the cost belongs to sunk cost, and the law enforcement cost includes de-order cost, friction cost and loses. The range of legal benefit should be defined by the object of the law. The paper also proposes the methods for quantifying the costs and benefits, meanwhile, theoretical framework of evaluation criteria of legal efficiency has been presented. Finally, we apply the theoretical framework to the analysis of the efficiency of forest logging quota management system.
