The Criminal Law Amendment (IX) pays much attention to maintaining social order, and prescribes more preventive crimes than ever before. Thus, some behaviors are criminalized beyond reason, which sometimes ignores the positive meanings of penalty relief. Moreover, this preventive legislation brings new challenges to the traditional criminal law doctrine, including its basic theoiy and explanation theoiy, which is developed based on retributive legislation. And therefore, the duality of the criminal law theory and the criminal legislation becomes more distinct to a certain extent. |
