論我國合作社社員附加表決權的法律規制

On Legal Regulation of the Member's Additional Vote Right in Cooperatives

當前我國合作社實踐中普遍存在的社員附加表決權導致了社員對合作社民主控制的虛化，從而對法律規制社員附加表決權提出了要求。我國社員附加表決權法律規制應以確保社員民主控制合作社為目標，但是，當前立法對法定附加表決權規制不力，對事實型附加表決權和合作社聯合社附加表決權缺乏規制。為保障社員對合作社的民主控制，我國立法應當對社員附加表決權從其授予到影響力再到行使進行全方位的規制，同時，將事實型附加表決權、合作社聯合社的附加表決權納入法律規制的對象範疇。

Currently, the ubiquitous inefficacy of member's democratic control of cooperatives, resulting from member's additional vote right, shows that it is necessary to regulate member's additional vote right by law. Our legal regulation of member's additional vote right should aim at ensuring member's democratic control of cooperatives. However, current legislation fails to regulate legal additional vote right, such as virtual additional vote right and additional vote right in cooperative union. To ensure member's democratic control of cooperatives, our legislation should extensively regulate member's additional vote right from its awarding, influence and exertion. At the same time, the virtual and cooperative union's additional vote right should be included into legal regulation.
