從量刑定罪視角探討卡其領貪污犯罪刑事政策

From the Perspective of Sentencing Conviction to Explore Criminal Policy of Khaki Collar Corruption

法律之於犯罪，法律是正義的最後一道防線，而犯罪學與刑事法律最大核心價值之不同在於：「尋求刑事制裁以外解決犯罪的方法」。定「罪」與否的問題是「刑事立法」的問題，也就是法律層面的問題；而「刑罰」才是「刑事司法」上的問題，同時，也才是折衷刑法規範學及犯罪事實學層面上之問題，本文以卡其領之貪污犯罪為例，除利用文獻探討論述重懲重罰與量刑關係在刑事政策上之爭議外，主要係以貪污犯罪判決書為樣本，透由量化分析犯罪訴訟特徵，及質性訪談「卡其領審判官」，探討是類犯罪型態在軍事環境下之刑事政策特徵；總之，量刑政策向來是刑事政策備受爭議的話題，除強調以貪污犯罪為例的卡其領犯罪強調各種犯罪都重視的「證據」（Evidence）外，也說明了在訴訟特徵中，量刑過輕不符國人期待，即便是嚴刑峻罰，最後還是也有救濟途徑可以作為後盾，但至少無可否認地，亂世用重點在教育上發揮「殺雞儆猴」的警惕效果，對於犯罪預防的方法上，雖然有限，但至少不無小補，併提出卡其領貪污刑事政策應強調提高風險、強化實體法及程序法上的防制措施及落實聯合國反貪腐公約之意識，以提供符合我國國情之本土化犯罪預防作為之參考。

With respect to the criminal law, the law is just the last line of defense. The biggest difference between the Criminology and Criminal Law is its core value: 'to find ways that solves the criminology than criminal sanctions.' Criminal Conviction belongs to 'criminal legislation', which is the legal aspects of the problem; and 'penalty' is the 'criminal justice' issues. Also, this is the problem of Criminology level. This article is based on the khaki collar corruption crime, for example, in addition to using literature review to describe the relationship between severe punishment and sentencing debate on criminal policy, but mainly adopting corruption crime verdicts as a sample, through the quantification and qualitative interviews 'the judge advocate of khaki collar 'who investigates this characterized type of crime patterns in the military criminal policy environment, as a reference to the prevention of crime.
