In the context of modernizing social governance and comprehensively promoting the rule of law, social negotiation serves as a crucial method to solve the conflicts between employers and employees. The social negotiation system for employers and employees should be improved at the legal level. This article analyzes main obstacles to the social negotiation system in the labor relations area. It argues that the advancement of the legalization of social negotiation system for employers and employees should rely on the following aspects: further defining the legal status of negotiation parties; legalizing the essential elements of the social negotiation system; establishing the defense right of performance system in labor contracts; implementing the social negotiation system through the legal mechanism ; and establishing the legal remedy system for the social negotiation system. |
