論我國合作金融行業組織體系的法律重構

On the Legal Rebuilding of Cooperative Finance's Industry Organization System in China

我國合作金融的發展亟需有效的行業組織。當前合作金融行業組織運行中的重重問題，要求從行業組織的模式和行業組織制度兩個方面對我國合作金融行業組織體系進行法律重構。對於合作金融行業組織的模式，我國既要選擇能滿足行業組織成員自由選擇需求和行業組織整體能力積聚需求的混合結構模式，又要在行業組織的具體組織形式上選擇合作制組織形式，並由法律對這兩種模式進行重構。對於合作金融行業組織制度，法律重構的重心主要在於對合作金融行業組織的設立、成員加入與退出、代表產生和多票權等制度進行設計。

Cooperative finance's development in China cries for efficient industry organization. Nowadays, there are many kinds of problems during the operating of the cooperative finance's industry organization. We need laws to rebuild the cooperative finance's industry organization system from two respects, namely, the industry organization's models and systems. For the industry organization's models, we should not only choose 'mixed structure mode' which can meet the members' need of free choice and the whole industry organization's need of gathering capacity, but also choose cooperative mode. Accordingly, such two modes should be rebuilt by laws. For the industry organization's systems, the task of legal rebuilding is to design systems about the establishment, members' entering and quitting, representatives' election and multi-vote right of the cooperative finance's industry organization.
