Good faith is the common heritage of legal culture or civilization of mankind which has been broadly applied both in domestic law and international law. In positive international legal system, good faith holds an important position and plays an essential role: firstly, it is a kind of general principle of law commonly recognized by all legal systems in the world; secondly, it constitutes an integral part of customary international law; thirdly, it bears the basic characteristics of fundamental principles of international law, namely, abstraction, generalization, universality and supremacy; fourthly, it is the foundation and core of treaty law, particularly in the process of treaty negotiation, interpretation and implementation. |
