“生態紅線”的規範效力與法治化路徑－－解釋論與立法論的雙重展開

The Normative Effectiveness and Legalization Path of 'Eco-Red Line'

“生態紅線”是當前我國生態環境保護領域的重大戰略決策與制度創新。僅從公共政策的角度看待並推行生態紅線，並不能確保其具有足夠的規範效力；生態紅線的真正“落地”，需要在解釋論和立法論兩個層面予以展開。根據解釋論，除個別領域外，目前我國已經建立起具有法律效力的生態紅線體系（包括生態功能紅線、環境質量紅線、資源利用紅線），並通過“法律強制模式”、“政府責任模式”、“績效管理模式”等不同方式加以適用。根據立法論，需要從實體和程序兩個方面，有針對性地在相應領域進行法律修改與制度完善，提升生態紅線制度的法治化程度。

“Eco-red line” is the major strategic decisions and institution innovation in the field of ecological and environmental protection in China. However, eco-red line is not only a public policy, but also needs to be legal rules and regulations. In order to implement the eco-red line, it shall be conducted in two levels, interpretation and legislation. In the perspective of interpretation research, the basic legal system of eco-recl line has been built (including functional eco-red line, environment quality eco-red line and natural resource eco-red line) with only a few exceptions and be applied by three different models (law enforcement, government accountability and efficiency management). In the perspective of legislation research, some rules need to be revised in substantive as well as procedural law to promote the legalization of eco-red line.
