The eight fundamental conceptions of the law (rights and duties, privilege and “no-rights”, powers and liabilities, immunities and disabilities) which are considered as “the lowest common denominators of the law” by Hohfeld can serve to be an analytical framework in probing the internal structure of ownership. The analysis provides a new perspective in reconsidering the meaning of ownership. The right of ownership is aggregation of jural interests and jural burdens. This realization will play an important part in reflections on the discussions centered on the definition of ownership, the characteristics of ownership and the legal restrictions of ownership and so on. |
