The purpose of this paper is to introduce several aspects of contemporary civil lawsuits in Japan, and to examine these aspects from the perspective of the procedural legal theory. First, the author, based on the theory of the judicial legitimacy, describes the postwar development and the present -- day feature of the doctrines of code of civil procedure in Japan, with a view to the theories of the purpose of lawsuits and of the due process of law, and then, he offers his own opinions on these subjects. Second, he examines the contemporary discussion on Judicial pattern, focusing on the division of roles of the parties and on the informalization of the legal procedure, and also, he presents the trend of the reformation of the civil procedure of late years in Japan. |
