Modern Privacy Right and Its Legal Step in the View of Comparative Law

無庸置疑，隱私權是人的一項重要權利，喪失了隱私，就喪失了為人的完整性。自從1890年美國學者沃倫和布蘭戴斯在《哈佛法律評論》上發表了《論隱私權》一文，隱私權在不同的法律體制下以不同的方式萌芽成長。本文旨在通過對隱私權發展歷史的論述，結合對兩大法系下各國不同的隱私文化和隱私權保護方式的分析來尋求隱私權的權利源泉，並以此為基礎構建一個完整的隱私保護體系。

There is no doubt that privacy is a significant right for human beings in modern societies. Without privacy, one will lose his integrity of being a human being. Modern privacy rights are gradually accepted and protected by most countries' legal systems. However, due to the differences of the civilization and legal history among countries, privacy rights are developed in different ways in different legal systems. The article aims to seek the resources of the right to privacy through tracing the history of privacy right and analyzing the differences of the protective ways of the right to privacy in legal systems. Based on above, the author aims to construct a compete protective system of the right to privacy.
