法典的未來－－論原則性法典

The Future of Code -- About the Principled Code

文本法律之時滯性與現實生活之變動性之間的衝突可謂成文法國家法治進程中永遠的痛。這種痛在我國表現得尤為明顯：為了使法律文本適應現實，即使是作為根本法之《憲法》也總是三番五次地被修訂。為緩解這種成文法之痛，學界作出了種種努力，其中最典型的就是宣導在司法實踐中運用法律方法對之進行救濟——遺憾的是，此種方法只能起到揚湯止沸的作用。文章認為，欲更大程度地緩解法律之時滯性，就必須釜底抽薪，進行原則性法典的創制，而原則性法典亦是將來法典之面目。

The conflict between the time-lag of code and the variety of reality is a difficult problem in the country with statute law, esp. in China. Many scholars have worked hard to solve it. However, all the existing ways and means can hardly settle the problem completely. The author believes that making principled codes is the ultimate method. Furthermore, the author points out the principled codes are the code are the codes in the future.
