In the ancient China, family-division, which has already lasted over 2000 years, is one of the most important usages regulating the family property. It is verified by our investigation that this usage still dominates the rural family possessions in China. The fundamental characteristic of this usage is that parents hand over the family property to every parents-offspring before death, divided equally according to the quantity of their sons. However, the current succession law disregards the existence of the usage so far. During the drafting of the Civil Code of the People’s Republic of China, it is inevitable mission for China civil law academic studies to judge how to academically analyze all kinds of civil customs via concepts, methods and theoretical frames of Western law. |
