物權法草案（第二次審議稿）若干條文的解釋與批判

從物權法草案（第二次審議稿）的內容看，大多數規定是正確的，有的規定因為不符合中國國情而顯得不適當，還有一些是違反常識的錯誤規定。草案在對不動產登記簿的“證據資格”、不動產登記的“權利推定”效力和“善意保護”效力，以及動產的“善意取得”等制度的規定上均存在明顯的理論錯誤和矛盾。筆者對這些錯誤和矛盾進行了分析和批判，並提出修改或廢除的建議，以期對立法者有所助益。

Examining the content of Real Right Law Draft (the Second Draft for Examination and Approval), we will find that most provisions are justifiable, some appear otherwise for being inappropriate to the situation of China, and others are against general understanding. Some provisions about the registration book such as its evidential competency, its constructive effect for qualified rights and its effect to protect bona fide third party, and provisions about bona fide acquisition for personal property are apparently theoretically wrong or contradict each other. The author analyzes these mistakes and then put forward some suggestions to modify or abrogate, hopefully to be beneficial to the presently going legislation.
