Two articles in the Constitution of Peoples’Republic of China involving civil law institutions were amended in 2004, article 11 and article 13. These two articles tell the Constitution’s attitudes towards the non-state-owned economy and private property. From all the amendments about the Constitution, it can be inferred that non-state-owned economy has been playing a more and more important role in China’s social life and the Constitution has been emphasizing its protection for the non-state-owned economy and conferring it an appropriate status. While the amendment about private property regulation is not scientific from the view of civil law theory. |
