民法法典化運動及其當代命運

未來中國民法典的成功編纂有賴於對現代民法法典化運動的全盤把握。只有當我們對上述問題有一個深刻的認識和理解之時，把未來的民法典置身於民法發展的歷史長河和當前的時代背景之下，編纂一部足以代表世紀立法精品的民法典才有可能。在此，文章從一個歷史考察和比較分析的角度，以古典主義法典化運動向現實主義法典化運動的轉變及隱藏於其後的理論背景和思想進路為主線，對民法法典化的發展脈絡及其當代命運作一些嘗試性闡述。文章最後的結論是，法典化不是民法發展的頂點和終結，而只是民法發展的一個階段，我們對於未來民法典的態度應是“通過民法典而超越民法典”，且以此為基礎實現民法的穩定與發展。

The successful codification of Chinese Civil-law depends on the abundant comprehension about modern codification movement. In a perspective of historical investigation and comparative analysis, this article focuses on the transformation from the classical codification to the realistic codification, and emphasizes the theoretic background and thinking approach behind this transformation. Moreover, the article illustrates the development of the codification of civil-law and it’s fate in modern society. The conclusion of the article is that, codification is not our goal but a measure. The code is not the zenith of the of civil-law, but a stage of it’s maturity. Accordingly, our attitude to the approaching code is “through civil-law code, beyond civil-law code”.
