In the coming years uniform rules of law regulating insurance contracts for private policyholders may be proposed by the European Commission, based in Brussels. In particular, among them are likely to be rules of law on aggravation of the risk during the insurance period: rules quite different from the rules of this kind now in force. This paper looks first at the current position in English common law, next at what is planned in Brussels, then makes a comparative assessment of current legislation on the subject in other countries in Europe, and ends with an estimate of what the uniform rules might be. |
