民法中“合意瑕疵”論的發展及研究

該文主要介紹了 “合意瑕疵” 理論的發展，並進行了若干研究。該文研究的重點在於，如何認識實際中進行了磋商，但是意思或意思形成的過程中存在問題的合意的效力，把此時的合意作為合意來處理必須具備哪些要件。該文首先對有關合意瑕疵的理論之爭做概述，重點介紹日本新近出現的對“合意瑕疵” 法律行為法的傳統制度構成進行擴張的新動向。接著介紹其幕後出現的判例所採用的侵權行為法律構成的動向，並探討其對法律行為法的影響。最後，以“合意瑕疵” 理論中有關自己決定論與法律提供特殊保護之間的衝突與整合問題作結論。

This article introduces the development of theory on“ agreement fault” and makes a study about it. It focuses on the effect of agreement which has problems in agreement itself or during the process of it’s forming. This article makes an overview about agreement fault theory disputes and analyzes the latest extending tendency of juristic act solution for agreement fault in Japan. It holds that the tendency derives from the preference to tort solution for agreement fault in practice, which has a strong influence on juristic act solution. Finally, it concludes with the conflict and harmony between selfdecision and legal special protection in “agreement fault” theory.
