According to the new trends of the latest international investment rules, China (Shanghai) Pilot Free Trade Zone experimentally adopted the “negative list” as the foreign investment administration mode, while the Sino-U. S. BIT negotiations will concentrate on the negotiations on the “negative list”.“Negative List” would become the strong force to promote further reform and opening-up of China, but at the same time, it is also the fundamental challenge against the existing foreign investment administration system, and its design shall be straightly related to the security and future development of the China’s foreign investment administration and the economic system. On the basis of the “negative list” of China (Shanghai) Pilot Free Trade Zone, combined with the design and structure of “negative lists”in the existing U. S. BIT/FTA practice, as well as the characteristics of China, this essay explores the specific research on Annex II of the “negative list” in the Sino-U. S. BIT negotiations. It shall contribute to the reform of China’s Foreign Investment Administration system, to the establishment of multilateral investment rules taking China as the core, as well as to support China to implement the “Silk Road” and “Marine Silk Road” Strategy. |
