Participation in Distribution: Analysis and Review

在我國有限破產主義立法模式下，為解決不具備破產能力的債務人向所有債權人公平有序地清償，強制執行中的參與分配程序應運而生。受此目的牽制，我國的參與分配制度在適用要件上有其特殊構成。為了保護當事人的實體權益和程序權利，實行參與分配必須準確把握申請期日、清償順位元以及分配程序，並在當事 人權利受到侵害時，通過參與分配方案異議和異議之訴予以救濟。

In the mode of limited bankruptcy doctrine, participation in distribution system is mainly to make the debtor without bankruptcy capacity to pay off all debts fairly and orderly. Under this objective, our participation in distribution system has its special composition. In order to protect the rights and interests of the parties, the application date, the Ranking of Claims and distribution program must be accurately grasped. When there has been a violation of the rights, parties may claim relief by distribution plan objection and objection lawsuit.
