Can a transitional society produce the spirit of the modern constitutionalism of democracy, human rights and the rule of law under the cogitation framework of transitional justice? This has been the core issue at the heart of the study of Transitional Justice in the recent years. Starting from an analysis of the concept of transitional justice, this paper tries to explore the intrinsic value entailed in it, and points out that the implementation of this idea will help to facilitate the democratic transition, the protection of human rights, and the realization of the principle of rule of law in a transitional society. In addition, by way of reflection on some of the other questions such as collective responsibility, social justice and good governance, this paper will also conclude with an integrated opinion noting that, although still an emerging field of study, the considered approach to transitional justice and its mechanisms in practice indeed remind us, that justice is not built on a romantic vain hope, but rather can be sustained by our constant reflection, learning and practice. |
