不動產登記法在性質上主要屬於登記程式法，應對納入不動產登記的權利類型、不動產登記的基本原則、登記管轄權、一般登記程序和特殊登記程序等問題作出規定。可以納入不動產登記的權利不僅限於《物權法》和其他法律中規定的物權，還包括法律和行政法規規定的可以登記的債權。不動產登記的主要功用是公示不動產上的權利狀態，但不動產登記對於不動產權利的變動所起的作用略有不同。不動產登記簿採取物的編成主義，只有權利人、利害關係人以及法律規定的國家機關才能查詢不動產登記簿。

Real estate registration law is registration process law in nature, dealing with the rights which may be registered in the real estate register, the basic principles of real estate registration, registration jurisdiction, general and special registration procedures, etc. The rights which can be incorporated into the real estate registration include not only the real rights stipulated in Property Law and other laws, but also the personal rights which be prescribed as registrable in the law and administrative regulations. The major function of the real estate registration is to make public the rights above the real estate, but the real estate registration plays a slightly different role in the change of real estate rights. Real estate register is asset-based registration. It can only be queried by the obligee, interested party, as well as the state organs stipulated by laws and regulations.
