Although the judicial practice has long recognized the effectiveness of pre-constitution interpretations, the reason is unclear yet. Reviewing legal frameworks of all pre-constitution stages, this study explores the background that judicial interpretations play their roles as statutes from the viewpoint of legal history. Since the Constitution emphasizes principles of supremacy of law and rule of law , this study claims all pre-Constitution era judicial interpretations would no longer be valid if any violation of constitutional order occurs. |
