行憲前司法解釋之檢討——以三則刑事法解釋為中心

A Constitutional Review of Pre-Constitution Judicial Interpretations - Focused on Three Criminal Interpretations

雖然我國實務向來皆肯認行憲前司法解釋之規範效力，不過其理由為何，卻未曾見進一步說明。本文以法制史的觀點為基礎，考察行憲前各階段之法制，並探討以司法解釋補充規範不足之法制背景。由於憲法強調法律優位與法律保留原則，因此，本文主張違反憲政秩序之行憲前司法解釋應不再援用。

Although the judicial practice has long recognized the effectiveness of pre-constitution interpretations, the reason is unclear yet. Reviewing legal frameworks of all pre-constitution stages, this study explores the background that judicial interpretations play their roles as statutes from the viewpoint of legal history. Since the Constitution emphasizes principles of supremacy of law and rule of law , this study claims all pre-Constitution era judicial interpretations would no longer be valid if any violation of constitutional order occurs.
