房市限購令的合憲性檢討——兼證基本權利限制的合憲性

Review on Constitutionality of Purchase Restriction Order – Also on the Constitutionality of the Restrictions of Fundamental Rights

當前的房市限購令涉及公民的諸多基本權利，應站在憲法高度，考量其合憲性。以基本權利限制之合憲性標準為審查依據，房市限購令侵犯了公民的交易自由權、財產權和平等權，存在違憲性。從重塑限購令合憲性角度出發，房地產市場調控應正確處理市場和政府間的關係，處理政府調控諸手段之間的關係，限購令應作為房地產市場調控的臨時性配套措施；推行限購令，應引入行政決策程式及公眾參與機制，嚴格界定限購令的適用條件；也應遵循法律保留原則，保障限購令合法合憲地推行。

Currently, purchase restriction order involves many of the basic rights of citizens, we should consider its constitutionality. Based on the standards of constitutional review, purchase restriction order violates the rights of trading liberty, property rights and the right to equality, which is unconstitutional. We should correctly handle the relationship between markets and Government, but also to deal with the relationships of various government regulations, purchase restriction order should be temporary and compatibility measure. In the implementation of purchase restriction order, we should strictly define the conditions； Also, we should follow the principle of reservation of law, guarantee legal and constitutional of purchase restriction order.
