The New Criminal Procedure Law of the P.R.C. in 2012- Focus on Defense and Action of Secretly Collected Information

2012年3月通過、2013年元月生效的中國大陸刑事訴訟法。當中的特定問題領域，首開先例對外就草案內容廣泛徵求意見，最終拍版採取許多不同於1996年刑事訴訟法的看法。由於新修部分調整的幅度相當大。為了能夠深入掌握新法的特色，也考慮到文章的篇幅，本文想聚焦在辯護制度以及秘密的資訊蒐集措施（技術偵查措施、臥底偵查員）。

The new Criminal Procedure Law of the P.R.C. is in 2012 passed and in January 2013 effective. For the first time are comments in some areas of problems on the outside asked. The new code has many changes as the old code in 1996. In the new code there are a lot of modifications. In order to present the important points of the new regulations this article will try to focus on defense, defender, and action of secretly collected information (survey with technology equipment, undercover investigators). At the same time these areas are also in Taiwan high concerned. The structures of discussion are based not only on die position und function of defender but also on the aspect of intervention of human right. Therefore can the both topics systematic introduced.
