二○一三年日月光K7廠排放廢水污染後勁溪，二審的高雄高等法院做出相關人員與日月光皆無罪的判決，引起社會譁然。然而，法院的判決是否輕率或有其論理基礎？法院不合理的判決，暴露出哪些問題？
本文透過檢視日月光二審判決與檢察官批評，分析法院論理的不足與可能因素，另方面嘗試探究法院之外行政機關與立法機關的角色。本文認為，法院判決的不合理僅是環境管制的冰山一角。在此之外，行政機關的怠惰與立法機關的眼高手低，都共同造成政府在面對環境議題上的窘境。 |
| 英文摘要 |
The K7 factory of ASE Group was found discharging wasted water and pollute Houji River in Kaohsiung. The court reviewed the case and held that ASE not guilty for the environmental deterioration. The public seriously criticized the judgment, however, the reasoning and the underlying problem may not be fully discussed and disclosed. This article examines the debate between the court and the prosecutor, on the one hand to analyze the possible deficit of the reasons, on the other hand to inquire the role of legislature and executive. This article argues that, the incompleteness of court’s decision is only a tip of the iceberg; legislature and executive also contribute to the failure of environmental protection.
