中文摘要 生物科技自一九九○年代以來,已逐漸應用於農業與食品等產業,對各國食品安全形成一項新的挑戰。針對生技產品或基改食品,各國一般採取更為嚴格的食品控制,以確保消費者權益及國民健康。本文針對歐盟生物科技及食品安全的發展概況、法律規定、風險評估等從事研析,以瞭解其以消費者保護為原則的立法精神及目標,並以風險評估作為食品安全及及生物科技的基礎,建立一項強度食安治理及生技政策。
英文摘要 Biotechnology has been applied in agriculture and food industries since 1990. Its application poses new challenges for ensuring food safety in many countries. As a result, governments frequently apply stricter regulations on biotech products and GM foods to protect public interests. In line with the existing jurisprudence on consumer protection, the EU has adopted strong food controls based on risk assessments of biotechnology and GM foods. This paper examines EU laws and risk assessments associated with biotechnology and food safety as the EU model is sui generis, and could provide many lessons and insights for Taiwan regarding the development of good governance practices with respect to biotechnology and food safety.
