中文摘要 | 由於C2C之網路交易日漸興盛,為協助完成價金交付以及確保履約之第三方支付服務亦於世界各國逐漸崛起,例如美國PayPal或中國大陸支付寶等。然而,由於第三方支付服務尚屬新興事業,業者與使用者之法律關係多有賴業者以單方訂定之定型化契約條款加以形成。因此,無可避免地對於若干交易上風險,業者亦可能藉由定型化契約條款轉嫁由消費者負擔。我國雖分別於二○一四年公告「第三方支付服務定型化契約應記載及不得記載事項」以及二○一五年訂定「電子支付機構管理條例」作為第三方支付之主要規範。然其內容上是否已針對各項交易風險提供消費者合理且足夠之保障?似仍有待進一步檢視。 |
英文摘要 | As the significant growth of C2C online transactions, the third-party payment service provider - such as Paypal in US and Alipay in China- plays an important role that assists the payment and secures the performance of contracts. However, among these emerging third-party payment services, most of the legal relations between providers and users rely on the standard terms and conditions which are unilaterally set by the providers. Hence the providers may transfer the transaction risks to consumers by these standard terms and conditions. This article is tending to figure out whether there are reasonable and adequate measures to protect consumers in the regulations, “Mandatory and Prohibitory Provisions of Standard Contracts to Be Used for the Third-Party Payment Service” and “The Act Governing Electronic Payment Institutions,” which were promulgated respectively at 2014 and 2015. |
