中文摘要 | 行動網路和智慧行動裝置的普及帶動網路平台崛起,同時創造出汽車共享的新商機。惟運輸資源的分配通常係屬於國家特許且高度管制之領域,平台的獲利模式及當中所參與之車輛和駕駛,與臺灣現行汽車運輸業監管框架多有扞格。本文將從客運運輸服務的變化切入,並借鏡美國立法例之變化,找出調整汽車運輸業法規框架之切入點,在接納新興運輸服務與傳統計程車客運業者異質性的同時,能減輕兩者之衝突並衡平各方利益,最後提出汽車運輸業監管框架可能之調適方向。 |
英文摘要 | The popularity of mobile network and smart mobile devices has resulted in the emergence of online platforms as well as the business opportunity of automotive sharing economy. However, the allotment authority of transportation resources usually resides in government. The profit-making model of platforms and the vehicles and drivers involved often violate Taiwan’s existing regulations. This article, based on the changes in Taiwan’s bus transportation services and US law, attempted to find a solution to adjust regulations of automotive carrier industry. While accepting the differences between emerging carrier industry and traditional taxi transportation, this article aims to reduce conflicts, strike a balance among relevant parties and propose a potential regulatory framework to automotive industry. |
