論「全自動化行政處分」與「正當行政程序相關規定及原則」間之關係

On the Relationship Between“Fully Automated Administrative Punishment”and“Relevant Provisions and Principles of Proper Administrative Procedures”

本文探討了在行政機關逐漸數位化的趨勢下，運用全自動化設備（如演算法和人工智慧系統）對行政決策帶來的影響。以「全自動化行政處分」為例，研究如何在提升行政效率的同時，確保遵循法治原則和保障人民程序權利，特別是在職權調查、意見陳述及閱覽卷宗的權利方面。本文同時參考德國法，並對臺灣現行行政程序法進行探討，期望能在政府數位化、智慧化的發展中，平衡效率與人民權利之保障。

In the process of pursuing digitization in administrative agencies, the use of various automated devices, i.e., algorithms and artificial intelligence systems, is bound to increase gradually in order to promote the efficiency of administrative decision-making. This article takes the“fully automated administrative disposition”as an example, which is currently under heated discussion. In addition to clarifying its definition, this article also hopes to find out, from the perspective of regulations and principles related to administrative law procedures, ways to pursue administrative efficiency while still taking into account the principle of the rule of law and the people’s rights to be effectively remedied.
