對於兒童的性犯罪──從兒童的健全成長與發達的觀點出發／深町晋也（譯文）

本文是以最近日本性犯罪修法過程中，關於監護人性交等猥褻罪的規定狀況，以及同意性交罪的同意年齡提高之修正為中心，除了介紹日本刑法學界關於此部分修法的各種立場以外，也在必要範圍內參照了德國刑法學最近的動向，做出饒富趣味的說明。並且，在實質的觀點上，對於日本的監護人等性交猥褻罪，以及關於同意性交罪的本質，也提出對於兒童的健全成長，作為共通的理解觀點。

This article focuses on the recent revision of Japanese Penal Code concerning regulations on sexual intercourse made by guardians, and the revision of the age of consent for the crime of sexual intercourse with consent of a minor. In addition to introducing the various theoretical positions in the field of Japanese criminal law on these revisions, it provides an interesting explanation with reference to recent trends in German criminal law. Furthermore, from a substantive point of view, this article suggests the healthy growth of children can be the base shared by the crimes mentioned in this article.
