規範理論作為普世刑法釋義學之基礎／Joachim Renzikowski （譯文）

本文解釋行為規範與制裁規範二元區分的基礎，此種區分與刑法學者Karl Binding有關，更可追溯到法學家Jeremy Bentham。本文特別就反對一元規範理論者，對其規範概念進行反駁。最後，說明對於處罰違反規範者而言，究竟有何後續推論。

This article explains the basis of the dualistic distinction between norms of conduct and sanction norms, which is associated with Karl Binding but goes back to Jeremy Bentham. Their concept of norms is defended against objections, especially of a monistic theory of norm. Finally, it is shown why the violationof a norm of conduct is punished.
