While the pervious references (Welzel, Vicen, Broeckman) locate the first mention of the term “Philosophy of Law” or rather “Legal Philosophy” in Gustav Hugos work “Lehrbuch des Naturrechts als einer Philosophie des positiven Rechts” in 1798, the term and the concept appeared very much earlier, especially as Latin terminus “philoisophia juris” in 17th Century. Gottfried Achenwall also used them in about the middle of 18th Century. The German version had already been used before Hugo in the end of 18th Century several times. This article traces the history of the term and the concept from the beginning in 17th to the 19th Century. |
