夫妻剩餘財產分配之適用程序與財務揭露義務之研究

A Study on the Applicable Procedures for Matrimonial Property Distribution Cases and Duty of Disclosure

婚姻制度受憲法制度性保障，當婚姻關係解消時所產生的夫妻剩餘財產分配請求權的實踐，基於公益性質要求，亦應有同等適用，於審理程序上是否有家事事件法第10條職權調查的適用，值得討論。另外，民法第1022條之夫妻互負婚後財產報告義務，該條內容在實務實踐結果為何，本文亦將一併討論，最後提出解釋論與立法論之改革方向。

This study intends to explore what procedures shall be applied to the matrimonial property distribution cases, by reviewing the court’s decisions and theory, to meet the requirements of institution protection under the Constitution. Finally, the main issues about the duty of disclosure for matrimonial property between theory and practice, will also be reviewed to see whether there are lessons that Taiwan can learn draw on from other jurisdictions.
