With the development of science and technology, the transmission of paper in the past has gradually been replaced by electronic transmission. In this context, this article studies the comparison, advantages and disadvantages of electronic delivery and paper delivery. The Electronic means of service abroad may not completely replace the means of paper service in mutual assistance. However, most of the fatal shortcomings that may be caused by paper delivery can be overcome by electronic delivery. There is no regulation about the mean of electronic or theological service abroad. However, the electronic delivery will be the future trend, so this article introduces the advantages of electronic delivery and compares the advantages and disadvantages of traditional paper delivery. This article compares the traditional paper service and electronic service of mutual legal assistance in a very nuanced way. Some situations are only revealed when there are real cases in practice, and the benefits of using extraterritorial electronic service for mutual legal assistance are demonstrated. Comparing the use of paper and electronic service for mutual legal assistance, electronic service seems to have more advantages than disadvantages. It is used in modern technology and timeliness, and it is gradually more in line with the needs of the times and living habits. Therefore, this article recommends electronic delivery for outof-territory delivery. This article also discusses the sovereign concerns, reasons, and subsequent development of the early mutual legal assistance failure to use direct service, as well as our country’s practical judgment ideas. |
