Through the analysis of related articles, this study discussed the professional autonomy of teachers in the elementary and secondary school with the perspective of judicial review. This study discussed three concepts. First, how is the legal status of the professional autonomy of teachers? Second, what is the meaning of indefinite legal concept, authorized discretion and judicial review, and how these are applied in education. Finally, providing court cases to explore how the judiciary examines the professional autonomy of teachers, and clarify the scope of professional autonomy of teachers. We hope teachers can fully show their autonomy and enhance their expertise and dignity under the circumstances of not violating the law during their teaching. |
