The United States, based on the Mayo decision, established the Alice/Mayo Test and released the patent eligibility examination guidance, with a revised version published in 2019. This article compiles and summarizes the practical application of the Alice/Mayo Test in the United States and various comments from different sectors. It introduces how this examination guidance affects patent applications, its impact on industries, and the evolution of several significant judgments. The article selects 11 cases, including both earlier and more recent relevant cases. It organizes the judgment factors emphasized by the courts during practical examinations and conducts abstract summarization. Through international legal experiences, the article also reviews the current status of examination guidance and practical judgments related to computer software inventions in Taiwan. |
