電腦軟體相關發明之專利適格性比較研究──以美國Alice/Mayo Test及其後續發展為中心

The Comparative Research of The Patentable Subject Matter Eligibility of Software-related Invention: Focusing on the U.S. Alice/Mayo Test and Its Subsequent Developments

美國根據Mayo案所建立之Alice/Mayo Test發布了專利適格性審查基準，並於2019年公布修訂版本。本文針對美國適用Alice/Mayo Test之實務現況與各界評論進行歸納整理，介紹該審查基準如何影響專利申請情形、對產業之衝擊、以及若干重要判決之發展。本文挑選11個案例，包含較早期與近期最新相關案例，整理出法院實務審查時所重視之判斷因素，並進行抽象化歸納整理。再藉由比較法上之經驗，回顧我國電腦軟體相關發明審查基準及實務判斷之現況。

The United States, based on the Mayo decision, established the Alice/Mayo Test and released the patent eligibility examination guidance, with a revised version published in 2019. This article compiles and summarizes the practical application of the Alice/Mayo Test in the United States and various comments from different sectors. It introduces how this examination guidance affects patent applications, its impact on industries, and the evolution of several significant judgments.
The article selects 11 cases, including both earlier and more recent relevant cases. It organizes the judgment factors emphasized by the courts during practical examinations and conducts abstract summarization. Through international legal experiences, the article also reviews the current status of examination guidance and practical judgments related to computer software inventions in Taiwan.
