Inappropriate sentencing causes a request for appeals. Since the death penalty is the ultimate punishment, the ruling usually details the grounds which reveal the procedure of reviewing sentences in the court of appeals. In this regard, this article dives into an unusual judgement of the Supreme Court of Japan on 10th December 1999 acknowledging that the life imprisonment was a clear violation of justice and the death penalty should be sentenced. Aligned with this ruling, supportive cases jointly describe the Japanese rationales, which might shed light on the judicial path for Taiwanese practice. |
